California Privacy Policy

Do California Residents have specific privacy rights?

Rights of California residents

Under the California Consumer Privacy Act ("CCPA"), those who live in California have the following rights under California Civil Code Section 1798.83 also known as the "Shine The Light" law.  If this section conflicts with any other section of the policy and you're a California resident, the section that is more protective of personal information will be controlling.  If you have any questions about this section or whether these rights apply to you, please contact us at legal@payneglasses.com.

We only allow our payment service providers to handle your personal information if we are satisfied, they take appropriate measures to protect your personal information. We also impose contractual obligations on the payment service providers to ensure they can only use your personal information to provide services to us and to you.

How Long Your Personal Information Will Be Kept:

We will keep your personal information while you have an account with us or while we are providing our services to you. Thereafter, we will keep your personal information for as long as is necessary:

To respond to any questions, complaints or claims made by you or on your behalf;

To show that we treated you fairl;

To keep records required by law;

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

Deletion

You have the right to request that we delete your personal information that we collected.  Please understand that this right is subject to certain exceptions under the CCPA—for example, we may need to keep your personal information to provide you with the services, to complete a transaction or to otherwise comply with your prior requests.  In these circumstances, we may deny your request.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

Non-discrimination/Protection Against Retaliation:

We will not discriminate against you for exercising your CCPA rights.  We will not deny you goods or services, charge you different prices for our goods or services, provide you with goods or services of a different level or quality, or suggest that you may receive a different price or rate for goods or services or a different level of quality of goods or services.

Exercising your CCPA rights

To exercise your access, data portability and deletion rights, you will need to send us a verifiable request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected personal information and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond. Requests that do not meet both of these requirements may not be responded to.  We will only use your personal information submitted in your verifiable request to verify your identity and complete your request.  You do not need to register an account with our Site to submit a verifiable request.

Once your verifiable request has been received, we will work to respond within 45 days.  We will not charge you a fee for making a verifiable request unless your request is excessive, repetitive or manifestly unfounded.  If we determine that your request warrants a fee, we will inform you of the fee and explanation of our decision before completing your request.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your personal information.  You may also make a verifiable request on behalf of your minor child.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).
